I posted the link to here in a FB group I'm in, and as I suspected it is falling on deaf ears. It's a small group, less than 50 people and maybe 5 of them ended up with a Loop, but thought they were getting a DS. None of them care. They all basically shrugged their shoulders when they found out what surgery they really got. The 2 comments I got on the post basically state "I love my surgery and my doctor". It's really sad.

Just a word of warning. I can't prove this is true but there is a big flap on that other sites FB group about Dr. Prachand perhaps passing off SADI/Loop as the DS. The individual this happened to is only a couple weeks out, and went in for the DS. And she says she is not the only one.

Do your due diligence and question, question, question.
 
Isn't failure to provide informed consent malpractice? I realize it can't be a class action suit, but on a case by case basis, can't these surgeons be sued by the patients because they did not consent to the procedure they had? If so, how would a patient go about finding a malpractice lawyer who would take the case on? What elements of the medical record must they have? I didn't get a copy of the informed consent paper that I signed on my recent surgery. Should all patients take get/keep the informed consent they signed even if they "love" the surgeon who may be later shown to have taken advantage of them?
 
Surgeons change behavior faster with lawsuits than professional medical group recommendations, no? How does a patient start a lawsuit against the surgeon? Could we get one law firm in the country interested in this topic who could represent different patients against several different surgeons, so the lawyers had a reduced cost of research and expert testimony on each case? 1-800-bad-Sadi ?
 
Thanks Becky... I will post my info here if I confirm i didn't receive a true DS. In the mean time I will try to educate myself on how to read the op reports.

If you aren't sure what you're reading on your op report, you can post the relevant part here and there are folks that can help decipher.

Let me guess - it was your informed consent form, and it was only in ONE place on that form.
 
I linked this thread for someone today so I went back and re-read it. I think I remember there are some malpractice claims pending about this issue. Does anyone have news?

I was thinking about this today and I believe it is under reported because-

1) People think surgeons are GODS and they are grateful to just be alive. After all, at least the surgeon didn't KILL them. Surgeon worship is real.

2) People don't want to admit they fell for the hype and misrepresentation. No one wants to feel stupid and admit they drank the Kool-aid. Newsflash...chances are you are not a surgeon and you have to rely on a medical professional who IS a surgeon. If that surgeon misleads you, you have become his/her victim. And that surgeon knows better, should be punished, and make things right for you. And if that individual also defrauded the insurance company, they should be punished for that too! Bottom line, you, the victim, are not responsible for the misdeeds of a surgeon you hired to HELP you.

We need to quit blaming the victim! And the victims need to quit blaming themselves and get angry instead! Direct your anger at the perpetrator!

I know some people get really turned off when we hit them up the side of their head about making sure they really 100% KNOW what surgery they are getting. This is why. Too many surgeons are quite willing to misrepresent what they do. They take advantage of people who are desperate to get help!

Personally, I think the surgeons already get to skate by too much. How many times have we heard about SSMO people getting the lap band because the doc promised they could lose the weight? If WE know that won't happen, the surgeon does too. People are still listening to surgeons and getting lap bands today. There isn't enough accountability. They just blame you when they knew the procedure had a 0% chance of success before they did the surgery. And you just take it because you are no stranger to another failed diet. It's always been your fault. In my mind, any surgeon still doing lap bands deserves to be sued! Over and over!
