I hurt way to bad. I don't have any fight left in me. Monday when I go to the doctor I am going to ask them to take me off work again
My job will then medically release me. I will apply for social security. Once and if i get that I will then apply for my medical retirement. I have fought the good fight trying to make it 2 years. I can't

Anyone have any thoughts or suggestions on how to proceed? @Larra @spikyBUnger @DianaCox @DSRIGGS
 
I can't help with any legal aspects as I'm not an attorney, but I think before you make any decision you should consult with an attorney with expertise in this field, as @DianaCox recommended.
What I can say is that you have to take care of yourself. If that means not working, then don't work. Don't jeopardize your health. But find out what your legal rights are too.
 
@Larra I definitely will see a lawyer first but to be honest I don't think it will change anything. For 3 years I have been fighting medical problems trying to keep this job that could give one Fuq about me. I have worked in pain for 3 years. Being harraaed by my racist supervisor. Trust me i never use the race card so if i say it they more than likely are! Hell for 3 months I brought my ass to work with an IV on my back. I don't love it anymore plus I think that if they medically release me I have a better chance at getting on social security disability which I need for my health insurance.
 
Okay, @Charris, speaking as someone who saw this from the front line...

My dh was medically retired in Feb 2009. His company decided it, not us. He also had LTD. His company actually was super nice and paid our COBRA for not just 18 months but longer than most...thru to Dec 2011, thank goodness. SSDI takes time to process. And almost everyone is denied the first time.

While we were waiting for his SSDI to kick in, his LTD covered our expenses (70% level which is higher than basic which is typically 50% but we paid to get covered at 70%. He finally got on SSDI in Oct 2010, we had to pay back the difference between SSDI and LTD. Yeah, we got all the back SSDI back to Feb 2009 but we owed it all to the company who handled the LTD. It wasn't until Feb 2011 that he was finally able to get on Medicare based on SSDI (there is a 2 year mandatory wait if disabled from the time of your disability as defined by SSDI).

When he filed for SSDI, I was already on it. (I was classified disabled in 1998, so my Medicare went into effect in 2000). I was very lucky in that I got mine first try. BUT I knew to have a lawyer handle dh's not me. I didn't want to get it in the middle of our marriage. We did end up paying the lawyer $6000 for all of it, paperwork, time, and even an appearance in front of a judge. See dh was denied not just once but twice so his had to go to a judge.

It's a long road...and most people are financially wiped out before getting there. Most companies have to provide COBRA but they make you pay for it. And COBRA is horridly expensive. Even if you start today, it will be June 2018 before you are allowed on Medicare (unless you turn 65 before that).

I'm so sorry for all of this, Charris. But I agree it is essential for you to consult an employment attorney before you say anything to them about medical release.

Will a beneficiary get Medicare coverage?

Everyone eligible for Social Security Disability Insurance (SSDI) benefits is also eligible for Medicare after a 24-month qualifying period. The first 24 months of disability benefit entitlement is the waiting period for Medicare coverage. During this qualifying period for Medicare, the beneficiary may be eligible for health insurance through a former employer. The employer should be contacted for information about health insurance coverage.

I'm SO sorry you're going through all of this @Charris. You've got some good support and plenty of advice here. In the end you will need to decide and do what is in your best interest.

See the attorney first before you do anything!

I can't claim to be all knowing about SSDI, etc but here's what I do know. You need to get ALL your medical records. Start asking your docs for letters saying you are disabled. The more the better. Get all the applications for SSDI. Start by reading everything and getting an idea what you need. Dot every *I* and cross every *T*. Every state has Social Workers who can help and many charitable organizations do as well. Just for example, Catholic Charities. Google! There is a ton of info out there! And I think Larra said almost everyone is denied the first time around. True! Be persistent.

I know someone who was approved on the first application. Getting SSDI is the key that opens all the other doors. The guy I know gets everything now. He has Medicare and Medicaid. Medicaid pays his Medicare premium and ALL of his medical is FREE. No co-pays, even gets glasses and prescriptions free. He can walk into any food pantry in town. He gets SNAP and a free cellphone. Meals on wheels. Free bus pass and he has a special card from the state that means he never has to stand in line/wait. He lives in Vegas now and I can say honestly, he has been to the doctor more in the year he has been here than I have in my entire life. Amazing if you consider he is basically healthy! He lives in senior subsidized housing, http://lasvegasliving.com/community/tempo . His apartment is nicer than my house. He pays $400 per month, all bills paid. He CAN set the AC on 70 all summer long! He has a great life here!
 
Oh C! I'm so sorry, but know you know what is best for you. Just please approach it methodically - with advice from a lawyer who has experience in this particular area. Don't rush in. Set the stage for the best future you can have. Hugs!

I don't have any words of wisdom either, C but I am very sorry it has come to this. That being said, please do see the attorney before doing anything. I know it is very hard but if you can make it one more week until you can see the attorney that would be best for you legally. The attorney might be able to get you time off with COBRA paid or something along those lines. Worth a shot.


Hang in there honey. I know this sucks and how hard emotionally, mentally and physically this is on you.
